Misdemeanor Versus Felony Charges: What Is The Difference?

Felony charges represent the most severe crimes, such as murder, rape or large-scale theft. The state typically punishes felonies with incarceration for more than one year, usually served in a state or federal prison. Sentencing can result in decades behind bars, substantial fines and the loss of certain civil rights.

Misdemeanor charges cover less-serious offenses, such as petty theft or simple assault. In Iowa, misdemeanors are classified as simple, serious or aggravated. Simple misdemeanors are punishable by up to 30 days in jail, serious misdemeanors by up to 1 year in jail, and aggravated misdemeanors by up to two years of incarceration. Depending on the case, a sentence may involve only fines, probation or community service. Even though misdemeanors are less severe than felonies, both misdemeanor and felony convictions create a criminal record.
